These terms (the “Terms”) are an agreement between you and MAGIC BYTE YAZILIM TİCARET LİMİTED ŞİRKETİ, Istanbul, Türkiye (“MagicByte”, “we”, “us”), for your use of Blob Park: Color Match (the “Game”). By installing or playing the Game you accept these Terms. If you do not agree, please do not play. Our Privacy Policy explains how we handle your information.
1. Who can play
The Game is intended for players aged 13 and over. If you are under the age of majority where you live, you confirm that a parent or legal guardian has reviewed and agreed to these Terms, including for any purchase.
2. Your licence to play
We give you a personal, limited, non-exclusive, non-transferable, revocable licence to download and play the Game on devices you own or control, for your own non-commercial entertainment. The Game, its levels, characters, art, music, code and all related rights belong to MagicByte or its licensors. You may not copy, sell, rent, modify, reverse engineer or distribute the Game except where the law expressly allows it.
The app stores’ own terms (the Apple Media Services Terms and the Google Play Terms of Service) also apply. Apple and Google are not responsible for the Game or its support. For apps downloaded from the App Store, Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them.
3. Virtual items and currencies
- The Game includes virtual items such as pearls, gems, paint drops, lives, boosters, costumes and park buildings (“Virtual Items”). Some can be earned by playing; some can be bought.
- Virtual Items are licensed to you, not sold. They have no cash value, cannot be exchanged for real money, goods or services, and cannot be transferred, traded or sold, inside or outside the Game.
- We may change, rebalance or retire Virtual Items and game content, for example when we update the Game. We will act reasonably and will not remove items you have paid for without a fair replacement or as required by law.
- Virtual Items stored only on your device can be lost if you uninstall the Game or lose the device without a cloud save. Linking an account in Settings helps you keep them.
4. Purchases
- All purchases are made through the Apple App Store or Google Play and are governed by their payment terms. We do not receive your payment details.
- Prices are shown in the Game in your store currency before you buy, including applicable taxes where the store requires it.
- Items are delivered to your Game after the store confirms the payment. If a purchase does not arrive, restart the Game while online, or use Settings → Restore purchases, then contact us.
- Consumable items (such as pearls, lives and boosters) are used up when spent. No Ads purchases are permanent and can be restored on a new device with the same store account.
- Refunds are handled by Apple or Google under their policies. Except where the law gives you a right to a refund, purchases are final. If you are a consumer in the EU, UK or Türkiye, you agree that digital content is delivered immediately after purchase and that you therefore lose your right of withdrawal once delivery starts, to the extent the law allows this.
- If a purchase is refunded or charged back, we may remove the purchased items or their equivalent from your account.
5. Ads
The Game is free to play and shows ads, including optional rewarded videos. Your ad choices are described in our Privacy Policy. Ads are provided by third parties; we are not responsible for advertisers’ products or websites.
6. Fair play
To keep the Game fun and fair, you agree not to:
- use cheats, hacks, bots, modified clients, or tools that change game files, memory, time settings or network traffic;
- exploit bugs instead of reporting them to us;
- obtain Virtual Items through unauthorised sources, or buy, sell or trade accounts or items;
- interfere with the Game, its servers or other players’ enjoyment;
- use any player name that is offensive, misleading or infringes someone else’s rights.
If you break these rules we may reset affected progress or items, or suspend or end your access to online features. Where reasonable, we will tell you why.
7. Updates and availability
We update the Game to add content, fix problems and change features, and some updates may be needed to keep playing. We may change game settings remotely, for example difficulty, events and offers. We try to keep the Game available but do not guarantee it will be uninterrupted or error-free. We may stop offering the Game in the future; if we do, we will give reasonable notice in the Game or on this website where possible.
8. Ending these Terms
You can stop playing at any time by uninstalling the Game, and ask us to delete your data via Delete account. Deleting your data permanently removes your progress and Virtual Items. We may end or suspend your licence if you seriously or repeatedly break these Terms.
9. Disclaimer
The Game is provided “as is” and “as available”. To the extent permitted by law, we make no warranties beyond those in these Terms. Nothing in these Terms limits rights you have as a consumer that cannot be limited by contract.
10. Limitation of liability
To the extent permitted by law, MagicByte is not liable for indirect, incidental or consequential losses, or for loss of data or Virtual Items, arising from your use of the Game. Our total liability to you for any claim is limited to the amount you paid us for the Game in the 12 months before the claim. We do not exclude liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be excluded by law.
11. Governing law and disputes
These Terms are governed by the laws of the Republic of Türkiye, and the courts and enforcement offices of Istanbul have jurisdiction. If you are a consumer, you keep the protection of the mandatory laws of the country where you live, and you may bring a claim in your local courts or consumer authorities. Please contact us first; most issues can be solved quickly by email.
12. Changes
We may update these Terms. We will change the effective date above and, for significant changes, tell you in the Game. If you keep playing after a change takes effect, the updated Terms apply.
